I just started compiling again and now since I do not have Milkshape I have to use 3ds max 2010. Every time I export and compile out of max the hand smoothing is borked and I cant figure out whats wrong. So now I'm asking compilers using max if they have a solution to this problem.

It looks like you simply have to apply smoothing groups. The autosmooth could probably solve it (honest!). Simple select all the polygons and apply it.
You could see what this tutorial tells you
If that's not it applying the whole thing to one group would probably do it and you could then fix problems.
Try adding turbosmooth and meshsmooth modifiers, see if that's the problem
